GENERAL TERMS OF USE
"USER MANUAL"
These General Terms of Use govern access to and use of the Website made available by RENAULT sas, whose registered office is located at 122-122 bis avenue du Général Leclerc – 92100 Boulogne-Billancourt, France, registered in the Nanterre Trade Register under number 780 129 987 (hereinafter "RENAULT").
RENAULT reserves the right to modify and/or update these GTU at any time and without notice, given the evolving nature of the connected services.
The GTU in force are those accessible by the User on the Website.
THE USER IS REQUIRED TO READ THESE TERMS CAREFULLY, WHETHER IN THE APPLICATION, BEFORE ACCEPTING THEM AND ACCESSING THE SERVICES.
Definitions
"Content" means, without limitation, the structure of the Website, the editorial content, the Notices, the drawings, illustrations, images, photographs, graphic charters, trademarks, logos, acronyms, company names, audiovisual works, multimedia works, visual content, audio and sound content, as well as any other content present on the Website.
"Manuals"means together the Vehicle Manuals and the Multimedia System Manuals.
"Multimedia System Manual(s)" means documentation detailing the operation, characteristics and use of a multimedia system integrated into a Vehicle.
"Services" refers to the various functionalities accessible through the Website.
"User" means any individual, whether an individual or a professional, who accesses the "User Manual" Website to consult and/or download the Vehicle and Multimedia System Manuals, without requiring the creation of an account.
"Vehicle" means vehicles of the Renault, Dacia and Alpine brands.
"Vehicle Manual(s)" means documentation relating to a specific vehicle model explaining its structure and operation.
"Website" refers to the "User Manual" website accessible without creating an account and offering free access to the Vehicle and Multimedia System Manuals published and provided by RENAULT. The Website is intended for the consultation and download of these Notices in web format and compatible with tablets and mobile phones. "Website" also includes the Content, documentation and all other elements and services that make it up, updates and new versions that may be made to the Website by RENAULT.
Purpose of the Website
User Manual allows the User to access an online platform, via the URLs www.user-manual.renault.com, www.user-manual.dacia.com, and www.user-manual.alpinecars.com, allowing him to download digital versions of the Notices.
The Services accessible via the Website are the following:
Consultation of Notices;
Download the documentation in digital version;
Access to video tutorials via a redirect to a dedicated YouTube page.
The list of Services is not exhaustive and may be modified at RENAULT's discretion at any time.
License to use
RENAULT grants the User a personal, non-exclusive, revocable, non-transferable, unlimited and free right to use the Website, the Content and the Services solely for his own needs in connection with the Use of the Website and the Services, to the exclusion of any other purpose.
It is strictly forbidden for the User to access and/or use the software components of the Website.
The User does not acquire any rights to the Website, the Content and/or the Services other than those granted herein.
Obligations of the User
The User undertakes to:
not to reproduce, even temporarily and/or partially, the Website and/or the Content by any means and in any form whatsoever;
not to use software or processes designed to reproduce and/or copy the Content;
not to adapt, modify, translate, transcribe, compile, decompile, assemble, disassemble all or part of the Website, the Services and/or the Content;
not to export the Website, and not to merge them with other computer programs;
not to create derivative works from the Website and/or the Content;
inform RENAULT if it becomes aware of an act of piracy and/or illegal or non-contractual use of the Website and/or its Content;
not to remove any copyright, trademark or other indication of reserved rights;
not to make any unlawful use, contrary to good morals and public order (such as, but not limited to, any content of a racial, pornographic or sexual nature).
Availability of the Website
RENAULT undertakes to make every effort to ensure and secure access, consultation and use of the Website. This is an obligation of means, taken into consideration of technical hazards, so that under no circumstances can the Website guarantee continuous and undisturbed use.
The Website is accessible at any time but may be interrupted, suspended or modified. Access to the Website may be interrupted, suspended in the event of force majeure, the occurrence of an event beyond the control of RENAULT, any breakdowns and maintenance interventions necessary for its proper functioning. The availability of the Website may still be interrupted in the event of intrusion, hacking, malfunction, breakdowns and constraints related to the operation of the networks or request from the authorized public authorities.
Liability – Exclusion of Liability
In compliance with the laws and regulations, RENAULT declines all responsibility for the use of the Website and gives no guarantee, express or implied, as to the access, speed, performance or quality of the Website or as to the use that may be made by the User of the data and/or information accessible via the Website, or the compatibility of the Services for a particular use.
RENAULT does not warrant that the Website and the Content will be free of errors, defects or omissions, or that they will not be subject to damage or attack, including viruses, that may cause malfunctions, service interruptions, breakdowns or loss of data or information. Access to the Website may be temporarily and periodically suspended for technical reasons, for which the technical teams will make every effort as soon as possible if necessary.
Access to and use of the Website is at the User's own risk. The User is responsible for taking all appropriate measures to protect their own data and/or software stored on their mobile phone and tablet against any intrusion or breach.
In any event, RENAULT will be exonerated from any liability:
in the event of non-compliance by the User with these GTU;
in the event of a malfunction of the Website due to a cause, voluntary or involuntary, attributable to the User or a third party or resulting from a malicious act, the malfunction of a software, smartphone, tablet PC or any other interface/product belonging to the User;
in the event of a malfunction and/or failure of the User's communication network, regardless of the cause;
in the event of direct or indirect damage resulting from the use of the Website while driving.
in the event of non-compliance with the terms of use specific to applications and/or websites published by third parties, any non-performance or partial performance of obligations by third-party publishers.
RENAULT may not be held liable for the Content (in particular texts, videos, images, photographs, etc.) and/or products and/or services offered by applications and/or websites published by third parties, all of which are the sole responsibility of these third-party publishers.
Intellectual and Industrial Property
The Website and its Content are protected by intellectual property rights and are the property of RENAULT or third parties that have authorized RENAULT to use them. Any reproduction, representation, use, adaptation or modification, by any process whatsoever and on any medium whatsoever, of all or part of the Website and/or the Content and/or the Vehicle models, without having obtained the prior authorization of RENAULT, is strictly prohibited and constitutes an infringement.
The User may not copy, modify, reproduce, represent, translate in whole or in part, in any form whatsoever, the information and elements appearing on the Website, nor act in such a way as to infringe the intellectual property rights of RENAULT and third parties who have authorized RENAULT to use them.
In general, the User does not acquire any property rights of any kind whatsoever over the know-how, company names, trade names, trademarks, copyrights, logos, patents and any other intellectual property rights related to RENAULT.
Applicable law
These GTU as well as all rights and obligations arising from or relating to the use of the Website, are subject to French law and are interpreted and applied in accordance therewith.
Any dispute relating to access to and use of the Website must be the subject of an attempt at amicable settlement between the parties before being submitted to the Courts of the jurisdiction of Nanterre to which the parties attribute exclusive jurisdiction, notwithstanding the plurality of defendants or the claims for compensation of third parties.
Miscalleneous
No Waiver
The fact that one of the parties does not invoke a clause of these GTU shall not be interpreted as a temporary waiver, let alone a definitive waiver, of the benefit of said provision, which will remain in force.
Nullity of a clause
If one or more provisions of these GTU are declared invalid, void or unwritten by virtue of the applicable regulations, modifications or following a final decision of a competent court, the other provisions remain in full force and effect.
Force majeure
Any event that has the characteristics of force majeure, and results in a malfunction of the Website, cannot engage the liability of RENAULT.
In addition to those usually retained by applicable national case law, the following are expressly considered to be cases of force majeure, governmental and legal restrictions and modifications, computer failures and telecommunications blockages, as well as server failures.
